Privacy Policy

This Privacy Policy describes how Defize Inc, a Delaware corporation (“Mogg,” “we,” “us”), collects, uses, and shares information when you use the Mogg mobile application, website, and related services (collectively, the “Service”). By using the Service, you agree to this Privacy Policy and our Terms & Conditions. If you do not agree, do not use the Service.
The Service is offered only in the United States and only to individuals 18 years of age or older.
Information We Collect
2.1 Information you provide
- Account information: username, email address, password or authentication credentials, and date of birth (used to verify you are at least 18).
- Profile information you choose to add, such as a display name or avatar.
- Prize redemption information: legal name, shipping address, phone number, and, where prize values meet tax reporting thresholds, taxpayer information such as a Social Security Number collected via IRS Form W9.
- Identity verification information: where we need to verify eligibility, age, or suspected multi accounting, we may collect government ID information directly or through a verification vendor.
- Communications: messages you send to support, survey responses, and feedback.
- Referral information: if you invite a friend, we collect the contact information you provide and associate the referral with your account.
2.2 Information collected automatically
- Device and technical data: device model, operating system, app version, IP address, device identifiers, advertising identifiers, language, and time zone.
- Approximate and precise geolocation: used to enforce jurisdiction eligibility and geo fencing. Precise location is collected only with your permission through your device settings; if you decline, we may rely on IP based location and may limit access to the Service.
- Gameplay data: the slates you build, picks, timestamps, results, points earned and redeemed, streaks, leaderboard standings, and prize store activity.
- Usage data: screens viewed, features used, session length, crash logs, and interactions with notifications.
- Anti fraud signals: device fingerprints, network signals, and behavioral signals used to detect bots, multi accounting, location spoofing, and collusion.
2.3 Information from third parties
- Analytics and attribution providers, such as install attribution for marketing campaigns.
- Identity verification vendors, who return verification results to us.
- Publicly available information, such as social handles, where you link or share content from the Service.
We do not collect payment card information in the app because there is nothing to purchase. We do not collect information from third party prediction market platforms about you, and we do not send your personal information to them.
How We Use Information
- Operate the Service: run the daily game, score slates, calculate and credit points, maintain leaderboards and streaks, and fulfill prize redemptions.
- Enforce eligibility and fair play: verify age, location, and identity; detect and prevent fraud, botting, multi accounting, and manipulation; enforce one account and one slate per day limits.
- Communicate with you: service announcements, results notifications, submission window reminders, support responses, and, with your consent where required, marketing messages. You can opt out of marketing and adjust push notifications at any time.
- Improve the Service: analytics, debugging, A/B testing of game parameters, and research on retention and engagement.
- Comply with law: tax reporting on prizes, sweepstakes record keeping, responding to lawful requests, and enforcing our Terms.
- Corporate purposes: audits, security, and evaluating business transactions.
How We Share Information
- Service providers: hosting, analytics, crash reporting, customer support, identity verification, anti fraud, email and push notification delivery, and prize fulfillment and shipping vendors. Providers are bound to use information only to provide services to us.
- Prize fulfillment: name, shipping address, and contact details are shared with fulfillment partners and carriers to deliver prizes.
- Tax and legal: taxpayer information is shared with tax authorities where required. We may disclose information to comply with law, enforce our Terms, or protect the rights, safety, and property of Mogg, our users, or others, including referral of suspected fraud to law enforcement.
- Affiliates: we may share information with corporate affiliates for purposes consistent with this Policy, such as security, audit, and business operations.
- Business transfers: information may be transferred in connection with a merger, acquisition, financing, reorganization, or sale of assets, including any future transfer of the Mogg product to a successor entity. The successor will be bound by this Policy or will provide notice of changes.
- Aggregated or de identified data: we may share data that does not identify you, such as winner counts, pick distributions, and engagement statistics.
- With your direction: if you share a slate card publicly, the content you share, which may include your username, is visible to others.
We do not sell your personal information for money.
Advertising and Analytics
We may use third party analytics and advertising attribution tools that collect device identifiers and usage data to measure campaigns and improve the Service. You can limit ad tracking through your device settings.
Your Choices and Rights
- Access, correction, deletion: you may access and update account information in app and may request a copy or deletion of your personal information by contacting us at hello@playmogg.com. Deleting your account forfeits unredeemed points, consistent with the Terms.
- Push notifications: manageable in your device settings.
- Marketing emails: opt out via the unsubscribe link.
- Location: manageable in your device settings; the Service may not be available without sufficient location information to verify eligibility.
- State privacy rights: depending on your state of residence, you may have rights to know, access, correct, delete, port, and opt out of certain processing, and the right not to be discriminated against for exercising rights. We will verify requests and respond within the time required by law. You may use an authorized agent where permitted.
Data Retention
We retain personal information for as long as your account is active and as needed for the purposes above. Gameplay and points records are retained for the life of the account plus the period needed for sweepstakes record keeping and dispute resolution. Tax records are retained as required by law. Anti fraud signals may be retained after account closure to prevent repeat abuse. We delete or de identify information when it is no longer needed.
Security
We use administrative, technical, and physical safeguards designed to protect personal information, including encryption in transit, access controls, and logging. No system is perfectly secure, and we cannot guarantee the security of information. Notify us immediately at hello@playmogg.com if you believe your account has been compromised.
Children
The Service is not directed to anyone under 18, and we do not knowingly collect personal information from anyone under 18. If we learn that a user is under 18, we will terminate the account and delete the associated personal information. Contact us if you believe a minor has provided us information.
US Only Service
The Service is operated from the United States and intended only for users located in eligible US jurisdictions. Information is processed and stored in the United States.
Changes to This Policy
We may update this Privacy Policy from time to time. We will post the updated version with a revised “Last Updated” date and, for material changes, provide in app or email notice. Continued use after the effective date constitutes acceptance.
